Terms and Conditions (T&C)
Overview
This website is operated by Eleganze. Throughout the site, the terms “we”, “us” and “our” refer to Eleganze. We provide this website, including all information, tools and services, to you on the condition that you accept the terms stated below.
By visiting our website and/or purchasing a product, you agree to these Terms and Conditions. If you do not agree to these terms, you may not use our website or access our services.
1. Scope
These T&C apply to all orders placed by consumers (§ 13 German Civil Code – BGB) through our website. Conflicting conditions from the customer will not be recognized unless we explicitly agree to their validity in writing.
2. Conclusion of Contract
The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to place an order. By placing an order, the customer submits a binding offer. The contract is formed when we accept this offer via email or dispatch the goods.
3. Prices and Payment Terms
All prices include the applicable statutory VAT and any shipping costs. The available payment methods are indicated during the checkout process. We reserve the right to exclude certain payment methods in individual cases.
4. Delivery
Delivery is made to the address provided by the customer. The delivery times are stated on the product page. If a product is unavailable, we will inform the customer immediately.
5. Right of Withdrawal
Consumers have a legal right of withdrawal of 14 days. For details, please refer to our Refund Policy.
6. Warranty
The statutory warranty rights (§§ 434 ff. BGB) apply. Any additional manufacturer guarantees remain unaffected by the statutory rights.
7. Liability
We are fully liable for damages resulting from injury to life, body, or health. For all other damages, we are only liable if they result from intentional or grossly negligent breach of duty by us or our agents. In cases of slight negligence of essential contractual obligations, liability is limited to the typical and foreseeable damage.
8. Website Usage
The user agrees not to use our website for unlawful purposes and not to transmit viruses or harmful software. A violation may result in exclusion from the use of our services.
9. Retention of Title
The goods remain our property until full payment has been made.
10. Changes to the Terms
We reserve the right to modify these T&C at any time. The current version will be published on our website. The version applicable at the time of the order is legally binding.
11. Applicable Law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection regulations of the country where the customer has their habitual residence remain unaffected.
12. Dispute Resolution
The EU Commission provides a platform for Online Dispute Resolution (ODR): https://ec.europa.eu/consumers/odr. We are neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
